Parents regain custody of son after losing him for seeking second medical opinion

Understandably, most parents would be despondent if authorities took away their sick infant child after they sought a second medical opinion at another hospital.

California couple Alex and Anna Nikolayev are overwhelmed by the international attention their case has received, but say they still intend to fight Child Protective Services despite getting back custody of their son on Monday, reports ABC.

Five-month-old Sammy Nikolayev was put into custody of the state last week because his parents didn't properly discharge him out of Sutter Memorial Hospital after being told he needed heart surgery. Sammy's parents have been taking him to Sutter since he was born and diagnosed with a heart mummer.

The couple wanted a second opinion from Kaiser Parmanente Medical Center, and after being told by the second hospital that is was fine to take their son home, they were surprised the next day when authorities showed up at their home and took their son into custody.

Anna was concerned by the level of care at the first hospital and did not trust the medical staff after they admitted to making a mistake, Fox News reports.

"I don’t want to let my baby have surgery in a hospital where I don’t feel safe,” Anna says.

On Monday, a judge returned custody of Sammy to them on the condition the parents follow all medical advice.

The boy is now being taken to Lucile Packard Children's Hospital at Stanford University where the parents assume he will get heart surgery after all.

Alex claims the day the police arrived at their home to take Sammy, they pushed him to the ground outside his home, took his keys, and entered the house without showing a warrant, Fox News reports.

Anna was inside the house and took a video of the whole incident.

“I’m going to grab your baby, and don’t resist, and don’t fight me, okay?” one officer presumably says to Anna in the recording.

The couple's lawyer claims the police over-stepped their legal boundaries.
